Bob Ruffato, a coal miner at Black Diamond, confined in the county jail as the result of a cutting affray that occurred at that place last Saturday night, has applied to Judge Tallman for a writ of habeas corpus directed to Sheriff Cudihee. This afternoon the sheriff must appear and show what legal right he has to keep Rufffato in jail.
The petitioner and his cousin, while under the influence of liquor, became involved in a quarrel in which the cousin was stabbed with a knife. The constable of Black Diamond arrested Ruffato as the assailant.
Since that time no steps have been taken to prosecute the Italian. The cousin is improving and states that he will not appear against Ruffato. As no crime has been charged Ruffato’s release is likely.
